Constructive Dismissal
Constructive dismissal can encompass two different types of situations. The first situation is when your employer makes a change to a core aspect of your job without providing you advance warning or without obtaining your consent to make the change. The change has to be fairly significant and greatly alter your employment. For example, your employer reduces your wages by 30% or ask you to move to work in a location several hours away. Again, these changes have to come without advance warning.
The second situation is when the workplace has become so toxic you can no longer go into work. For example, you are experiencing severe harassment and bullying from a supervisor and you have complained to HR and upper management on several occasions but the harassment and bullying continue without any intervening from your employer.
