What We Do: Employment Law
Given the quickly expanding population of Barrie and the ever-changing needs of its residents with respect to their employment, the employment lawyers at Ertl Lawyers have developed an expertise in dealing with a variety of employment law issues that people who live or work in Barrie may be experiencing. If you are an employee facing a wrongful dismissal or inadequate severance package, or you are an employer looking for employment contracts, Ertl Lawyers can help you.
Termination of Employment
If you have been terminated without cause, it is likely that our employer has provided you with some sort of severance package comprised of several components. This is because your employer has some minimum requirements, by law, that it must follow when terminating your employment.
First, your employer must give you notice that your job will be ending or they can pay you instead of providing you notice (pay in lieu).
Second, you might also be eligible for severance pay. This is an extra payment on top of the notice that is provided to you if you have worked for the company for over 5 years and the company has a payroll of over $2.5 million.
Lastly, your employer might offer you a gratuitous payment if you agree to the terms of the termination letter and sign the paperwork.
A termination without cause is when your employer has decided to let you go at no fault of your own, for example, company restructuring or downsizing.
Before you sign anything, make sure you contact Ertl Lawyers, employment lawyers in Barrie, to have your termination package reviewed. You might be entitled to more compensation.
Check out our Severance Pay Calculator to see what your severance package entitlements could be.
Termination with Cause
Termination with cause is when an employer terminates your employment on allegations that you have done something so wrong that they can no longer employ you. When you are terminated for cause, your employer does not have to provide you with any compensation or severance package.
Examples of a termination for cause can include gross incompetence, neglect of duty, fraud, dishonesty, insubordination or theft. Termination for cause can also cover issues such as assaulting a colleague or breaching company policies.
If your employer has terminated you for cause, don’t give up. You might still be entitled to severance.

Constructive Dismissal
Constructive dismissal can encompass two different types of situations. The first situation is when your employer makes a change to a core aspect of your job without providing you advance warning or without obtaining your consent to make the change. The change has to be fairly significant and greatly alter your employment. For example, your employer reduces your wages by 30% or ask you to move to work in a location several hours away. Again, these changes have to come without advance warning.
The second situation is when the workplace has become so toxic you can no longer go into work. For example, you are experiencing severe harassment and bullying from a supervisor and you have complained to HR and upper management on several occasions but the harassment and bullying continue without any intervening from your employer.
If you have experienced either of the above, or you aren’t sure if you have a constructive dismissal claim, Ertl Lawyers, Barrie employment lawyers, can help you. Contact us to find out more about your rights and visit our webpage on Constructive Dismissal for more information.

Frequently Asked Questions
How much severance pay am I entitled to?
Often, employees sign a job offer letter or employment contract when they are hired, and it may talk about termination in that document. Ertl Lawyers can review this document for you and let you know if you could be entitled to more money when you are terminated.
You may be entitled to additional compensation, called reasonable common law notice, if your employment contract does not limit your entitlements or if you do not have an employment contract at all.
it is best to have your employment contract reviewed by the employment lawyers at Ertl Lawyers to determine what you might be eligible for.
Am I entitled to severance pay if I quit my employment?
If you quit because you just didn’t want to work there anymore or you got a new job, you are not entitled to severance pay.
What is wrongful termination or wrongful dismissal?
Does the reason for my termination matter?
When your employer terminates you for cause then the reasons become much more important. Your employer has to tell you why you are being let go because you ought to have the opportunity to defend yourself. When an employer wants to terminate someone for cause, there is a very high burden they must prove in order to show that there actually was cause to terminate you and that you were being a bad employee on purpose.
If you were terminated because of your age, sex, religion, etc., then it matters because it could potentially be a violation of the Ontario Human Rights Code.
